Welcome to High Vibe Hypno. In these Terms of Service, “we”, “us” and “our” refers to High Vibe Hypno. These terms and conditions apply to all visitors, users, and customers of our website and services.

By accessing our website or purchasing our products/services, you agree to be bound by these terms. We reserve the right to amend these terms at any time.

1. ELIGIBILITY & USE

  • Age: Our services are intended for adults aged eighteen (18) years or over. By purchasing, you represent that you are at least 18.

  • Global Access: While we provide services globally, these terms are governed by the laws of Queensland, Australia.

  • Licence: We grant you a limited, non-transferable licence to access our content for personal, non-commercial use. Any reproduction or distribution without written permission is a breach of the Copyright Act 1968 (Cth).

 

2. PRICING & PAYMENTS

  • Currency: All prices are in US Dollars (USD).

  • GST: For Australian residents, prices are inclusive of 10% Goods and Services Tax (GST).

  • Payment Methods: We accept payments via Stripe, PayPal, and Bank Transfer (AU only).

  • Price Changes: We reserve the right to change prices at any time; however, orders already placed will be fulfilled at the original purchase price.

 

3. AUSTRALIAN CONSUMER LAW GUARANTEES

Nothing in these terms is intended to exclude or limit any rights you have under the Australian Consumer Law (ACL).

  • Our services and products come with guarantees that cannot be excluded.

  • For Major Failures, you are entitled to a refund or replacement.

  • For minor failures, we will rectify the issue (e.g., providing a working download link) within a reasonable timeframe.

 

4. DIGITAL PRODUCT POLICY (Courses & Recordings)

  • No Refund for Change of Mind: Due to the instant accessibility and "downloadable" nature of digital products, we do not offer refunds if you simply change your mind or decide the product is no longer for you after purchase.

  • Satisfaction Exchange: If you are dissatisfied, we offer a one-time exchange for another digital product of equal value within 30 days of purchase (limit 1 per customer).

  • Technical Issues: If a file is corrupt or a link is broken, please notify us within 14 days so we can provide a replacement.

 

5. PERSONAL SERVICE POLICY (Consulting & Packages)

For 1-on-1 packages (e.g., Rich Chick Embodiment):

​

  • Cancellations: You must provide 24 hours' notice to reschedule a session. Cancellations within 24 hours result in the session being forfeited.

  • Termination: If either party feels the partnership is not a "fit," the contract may be terminated. You will be refunded the remaining balance minus the value of sessions already conducted and digital materials already provided.

  • Facilitator Inattendance: If we cancel with less than 48 hours' notice, you will receive a bonus session as a gesture of goodwill.

 

6. IMPORTANT HEALTH & SAFETY DISCLAIMERS

  • Non-Medical: We are not doctors, psychiatrists, or psychologists. Hypnosis and consulting are for educational and self-development purposes and are not a substitute for professional medical advice or mental health treatment.

  • Safety: Never listen to hypnosis recordings while driving or operating machinery. Use recordings only in a safe, quiet environment.

  • Assumption of Risk: You accept full responsibility for your mental and emotional state before, during, and after using our materials.

 

7. NO FINANCIAL ADVICE DISCLAIMER

  • General Information: Any information regarding wealth, business, or money mindset is general in nature.

  • Professional Advice: We are not licensed financial advisers or accountants. We do not provide "financial product advice" under the Corporations Act 2001 (Cth). You should seek independent advice from a qualified professional regarding your specific financial situation.

  • No Guarantees: Results vary based on individual effort and background. High Vibe Hypno does not guarantee specific financial or business outcomes.

 

8. INTELLECTUAL PROPERTY

All content, including hypnosis scripts, recordings, course materials, and layouts, is the intellectual property of High Vibe Hypno. You may not share, sell, or mirror our content.

 

9. LIMITATION OF LIABILITY & INDEMNITY

​

  • To the full extent permitted by law, our liability for any breach of a consumer guarantee is limited to supplying the goods or services again or paying the cost of having them supplied again.

  • You agree to indemnify High Vibe Hypno against any claims, damages, or legal fees arising from your use of the website or breach of these terms.

 

10. DISPUTES & JURISDICTION

  • Chargebacks: You agree to contact us directly to resolve any issues before initiating a chargeback through your bank/Stripe.

  • Governing Law: These terms are governed by the laws of Queensland, Australia. Any legal proceedings shall be conducted in the courts of Queensland.

 

11. PRIVACY

Your use of our website is also governed by our Privacy Policy, which outlines how we collect, store, and protect your data in accordance with the Privacy Act 1988 (Cth).
